Book Easy Terms and Conditions

These are the terms and conditions on which you are offered access to Book Easy Limited. All booking services for activities, attractions, and products are subject to these. If you do not accept these terms and conditions, you must refrain from using Book Easy Limited and its online services.

These terms and conditions may be amended by Book Easy Limited from time to time. Amendments will be effective immediately upon posting on the website. You must review the latest terms and conditions regularly. Your continued use represents agreement to the amended terms.

Registration and Membership

1.1 Registering as a Book Easy member is free.

1.2 By registering, you certify you are at least 18 years old and can form a legally binding contract with us.

1.3 You must provide current and accurate personal details. You are responsible for updating your details.

1.4 You cannot register under multiple identities.

1.5 We reserve the right to suspend or terminate membership at any time. Terminated members cannot re-register under a new alias.

1.6 You are solely responsible for keeping login details secure and confidential.

1.7 We may contact you by email about transactions, activities, promotions and marketing.

1.8 You may unsubscribe at any time from newsletters using the clear instructions provided.

1.9 You are responsible for all actions undertaken with your login credentials.

Services

2.1 Book Easy connects users with operators of activities, attractions and services.

2.2 You agree to use our website and services searches and bookings only.

2.3 Upon a booking being confirmed, you are deemed to form a contract directly with the operator of that activity.

2.4 You must only make bookings you intend to use and pay for. Speculative, false or fraudulent bookings are prohibited.

2.5 Book Easy is not party to any agreement between you and an operator.

2.6 Book Easy is not responsible for any dispute resolution between you and an operator with whom you have an agreement. Disputes must be resolved by those booking and the operator.

2.7 Book Easy will take reasonable efforts to ensure accuracy of information contained on its website but does not guarantee error-free presentation. Book Easy does not accept liability for any errors or omissions and may change information displayed without notice.

2.8 Book Easy is not responsible or liable for any unavailable services indicated as available by an operator.

2.9 Book Easy is not responsibility for cancellations, changes, delays, losses or expenses arising from an operator's actions or inactions.

2.10 Book Easy makes no warranty or representation regarding suitability or quality of any listed service.

2.11 You assume all risks associated with participating in operator activities and release Book Easy from all liability. Risk management is solely the responsibility of the operator.

Exclusion of Liability

3.1 Without affecting your statutory rights, Book Easy accepts no liability for losses or damages arising from site or service use.

Payments, Fees and Charges

4.1 Book Easy may change its fees and payment processes at any time. New services may have different fees unless stated otherwise.

4.2 Payments are processed by Book Easy Limited in NZ dollars inclusive of GST, unless otherwise stated.

Cancellations, Changes and Refunds

5.1 Whilst Book Easy is not responsible for dispute resolution, customers may contact Book Easy in the first instance for dispute assistance, refunds, cancellations, returns and support regarding the site.

5.2 You must comply with each operator's own cancellation, booking amendments and refund policies. Non-refundable products cannot be changed or refunded.

5.3 Operators decide if refunds are approved. Refunds must be authorized before requesting this from Book Easy.

5.4 Approved refunds will be credited to you less a 10% cancellation fee (minimum $5).

5.5 Rescheduling a booking may be possible if consent is granted by the operator. Check with them directly.

Ratings and Comments

6.1 Your ratings and comments must reflect your personal experiences and be factually accurate.

6.2 Comments must not be offensive, defamatory, misleading or used for commercial promotion.

6.3 You grant Book Easy a license to any images uploaded for comment moderation purposes. You attest that you own or have rights to uploaded images.

6.4 Book Easy is not responsible for any posted opinions. You take full responsibility for comments and agree to indemnify Book Easy from liability.

6.5 We may edit or remove inappropriate comments but are not obligated to do so.

6.6 Comments are just for site operation and must not be exported elsewhere.

Privacy

7.1 Book Easy may collect your personal information through site and service use, including registration details and usage data. You agree Book Easy may use this to provide services, verify users, research usage, contact you, personalized marketing, and for other authorized purposes.

7.2 You agree Book Easy may share your data with trusted third-party service providers to operate our site and services.

7.3 Book Easy is authorized to provide operators all information needed to facilitate your bookings.

7.4 Book Easy may not sell or share personal data without consent, but may disclose it to authorities if required to by law.

7.5 Book Easy may amend this Privacy Policy to reflect legal privacy obligations but must notify you of any changes.

Third Party Sites

8.1 Book Easy is not responsible for, nor endorse, any third-party sites or content accessed through the Book Easy site.

8.2 Book Easy does not accept responsibility for reliance upon or offense from third party content, products or services.

General

New Zealand law governs these terms. You submit to the non-exclusive jurisdiction of New Zealand courts.

Book Easy will strive to ensure site availability but takes no responsibility for any unavailability or data corruption. Book Easy does not warrant the site against uninterrupted, error-free or virus-free operation.

Book Easy owns all intellectual property rights to our site, services, software and content. You agree not to:

• Copy, collect or harvest our data or content

• Reverse engineer, disassemble or decompile our software

• Overburden our systems.

Book Easy may collect personal information to provide services, verify users, research usage, contact you and personalize marketing. Book Easy may share all such data with trusted third party service providers to operate its site and services.

Book Easy will not sell or share your data without consent, but may disclose it to authorities if required to by law.
